Terms of Service

By accessing or using A360 AI Inc. ("A360 AI," "we," "us," or "our") website at a360ai.com or our AI lead-capture, follow-up, and booking platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

A360 AI provides AI-powered assistants that capture inbound leads, respond to inquiries via phone, SMS, email, and web chat, follow up automatically, qualify prospects, and book appointments on your calendar. The Service includes a client portal accessible at app.a360ai.com.

To use the Service, you must provide accurate account information and keep it current. You are responsible for:

• Maintaining the security of your account credentials and client portal access;
• All activity that occurs under your account;
• Ensuring you have proper consent to capture and contact leads through the Service, including SMS consent as described in our SMS Terms & Conditions;
• The accuracy and legality of any scripts, prompts, or configuration you provide to your AI assistants.

You must be at least 18 years old and authorized to enter into these Terms on behalf of your business.

You agree not to:

• Use the Service for any unlawful purpose or to violate any law or regulation;
• Send unsolicited or non-consensual SMS, email, or call communications (you must have proper opt-in consent from contacts);
• Upload or transmit viruses, malware, or harmful code;
• Attempt to access, tamper with, or disrupt the Service, its servers, or other users' accounts;
• Resell, sublicense, or redistribute the Service without our written consent;
• Use the Service to harass, defame, or deceive others.

The Service includes SMS text messaging features. You are responsible for obtaining proper opt-in consent from your contacts before sending SMS messages and for complying with all applicable laws and carrier requirements, including 10DLC campaign registration. See our SMS Terms & Conditions for details. We may suspend messaging on your account if we detect non-compliant activity.

Subscription fees are billed on a recurring basis as described at signup or in your account dashboard. You authorize us to charge your payment method for all applicable fees. Fees are non-refundable except as required by law. We may change our fees with reasonable notice.

The Service, including its software, design, branding, and content, is owned by A360 AI and protected by intellectual property laws. You retain ownership of the lead and customer data you provide through the Service. We retain a limited license to process your data solely to provide the Service.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that AI assistants will always produce accurate results. You use the Service at your own risk.

To the maximum extent permitted by law, A360 AI and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of or inability to use the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold harmless A360 AI from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party rights (including SMS/messaging compliance violations).

You may cancel your account at any time through the client portal or by contacting support. We may suspend or terminate your account if you violate these Terms or for any other reason with notice. Upon termination, your right to use the Service ends immediately.

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles. Any disputes will be resolved in the courts located in Florida.

We may update these Terms from time to time. We will post the updated version on this page with a revised "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
